Welcome to VisionMuse Marketplace. Please carefully review the following Terms & Conditions before engaging in any transaction, purchase, sale, or activity on the platform.
1. MINTING RESPONSIBILITY
The responsibility for minting an artwork into an NFT rests solely with the original creator/artist of the artwork. Third parties are not permitted to fully cover or assume minting fees for artworks they did not originally create.
2. ARTIST REPRESENTATIONS & WARRANTIES
By listing or minting artworks on the platform, the artist represents and warrants that:
• They are the original creator and lawful copyright owner of the submitted artwork(s).
• The digital files, images, and metadata provided are accurate and authentic representations of the original works.
• The artwork does not infringe upon the intellectual property rights, copyrights, trademarks, or rights of any third party.
3. COLLECTOR REPRESENTATIONS & WARRANTIES
By purchasing NFTs through the platform, the collector represents and warrants that:
• The purchase is made for legitimate collecting, ownership, or investment purposes.
• They acknowledge that ownership of an NFT does not transfer copyright or commercial intellectual property rights unless explicitly stated otherwise by the artist.
• They will not unlawfully reproduce, distribute, exploit, or claim ownership of the underlying artwork.
4. PAYMENT CONFIRMATION & NFT TRANSFER
Upon a successful NFT purchase, the transfer of the NFT to the collector shall only be completed after the artist's payment has been successfully processed, received, and officially confirmed by the platform.
VisionMuse Marketplace reserves the right to delay or suspend transfers in cases involving payment verification, security concerns, disputes, or suspected fraudulent activity.
5. ROYALTIES ON RESALE
Artists and eligible users are entitled to receive a 30% royalty on every successful resale transaction of their NFTs conducted through the platform.
Applicable royalties will be automatically calculated and distributed in accordance with the marketplace's royalty and resale policies.
6. NFT RESALE RIGHTS
Collectors and users who purchase NFTs through VisionMuse Marketplace are permitted to resell their NFTs, provided that all resale activities comply with the platform's policies, applicable laws, and marketplace guidelines.
The platform reserves the right to restrict or remove listings that violate its resale standards or operational policies.
7. COMPLIANCE & PENALTIES
Failure to comply with any of these Terms & Conditions may result in disciplinary actions including, but not limited to:
• Account restrictions
• Suspension or termination of marketplace privileges
• Removal of NFTs or listings
• Financial penalties or withholding of transactions
• Permanent account bans where necessary
VisionMuse Marketplace reserves the right to take any action deemed necessary to protect the integrity, security, and proper operation of the platform.
